Nell’anno dell’Incarnazione del Signore 1310, il giorno 28 del mese di luglio VIII indizione, mentre regnava il serenissimo Signore per grazia di Dio Federico III, nell’anno XV del suo felice regno. Amen.

Noi Bertoldo, per grazia di Dio Vescovo Agrigentino, per mezzo del testo del presente scritto pubblico, in presenza dei signori Salimbene, medico Giudice della Città di Agrigento, Giovanni di Pietro da Alessandria anche lui pubblico Notaio della Città e dei testimoni sottoscritti, convocati e personalmente invitati a questo scopo, dichiariamo e rendiamo noto a tutti che il magnifico signor Manfredi di Chiaramonte, per grazia di Dio e del Re egregio Conte di Modica, signore di Ragusa e Siniscalco Regio, teneva e possedeva un certo tenimento di case in parte terranee e in parte solerate (al piano superiore n.d.r.) nella predetta città di Agrigento, con i confini più avanti descritti, il cui suolo, con una fabbrica in esso fatta, un tempo era stato concesso dal Capitolo della Maggior Chiesa Agrigentina alla nobile signora Giacinta di Catania al censo annuo di un rotolo di cera e da lei era stato edificato come si trova. Noi avevamo provveduto a far revocare tale tenimento di case alle mani e al possesso della Chiesa, come poco conveniente. Tuttavia, il detto signor Conte domandò a noi per sé e per i suoi eredi il tenimento di case e un certo casalino della nostra predetta Chiesa, che era consuetudine concedere a censo annuo unitamente al predetto tenimento di case dalla parte di occidente, e chiese che fosse locato e concesso a censo annuo, offrendo alla nostra Chiesa tutti gli anni per la festa di S. Gerlando per il predetto tenimento di case  tre rotoli di cera e per il predetto casalino onze 10 di cera.

Noi, considerando l’utilità della nostra Chiesa nella predetta concessione, con il consenso degli infrascritti Canonici di tutto il Capitolo della nostra Chiesa, dopo aver avuto su questo argomento una diligente discussione, aver esaminato pienamente la deliberazione, con lo scopo di fare il meglio per la nostra Chiesa, abbiamo affittato e concesso il predetto tenimento e il casalino con i limiti, i diritti e le pertinenze al signor Conte e agli eredi in cambio dei predetti tre rotoli di cera e dieci onze da pagare ogni anno e in perpetuo alla nostra Chiesa per la festa di S. Gerlando. Tali tre rotoli e dieci onze lo stesso signor Conte per sé e per i suoi eredi offrì e promise solennemente di pagare alla nostra Chiesa ogni anno per il predetto censo annuo del tenimento di case e del casalino. Abbiamo concesso allo stesso signor Conte e ai suoi eredi, in virtù della predetta concessione, di avere, tenere, possedere, vendere, alienare e fare ciò che desidera come di cosa propria, salvo il predetto censo  annuo.

Noi conveniamo e promettiamo allo stesso signor Conte e ai suoi eredi di difendere, garantire e proteggere dalle calunnie da parte di ogni persona pubblica o privata che sia contraria per noi e per i nostri successori nella stessa Chiesa e contro la stessa concessione, che se per caso per un biennio il pagamento del canone non fosse fatto, sia lecito a noi e ai nostri successori di entrare, prendere e revocare il tenimento e il casalino al possesso della stessa Chiesa. Inoltre, se vorranno vendere, non osino vendere senza aver interpellato la nostra Chiesa, che se sceglierà di comprare, sia lecito ottenere il prezzo ridotto della decima parte, e non osino vendere ad un’altra Chiesa Ecclesiastica o a persona più potente.

Convenute tutte queste cose sopra nominate, promettiamo per noi e per i nostri successori di tener fermo l’accordo nel tempo ed osservarlo inviolabilmente rinunziando ad ogni diritto scritto e non scritto, all’eccezione del dolo, del difetto che capita nel contratto o all’azione del dante causa al contratto, affinché potessimo in qualche modo giovare alle costituzioni e a tutte le consuetudini e generalmente ad altri aiuti e benefici derivati tanto dal diritto canonico quanto dal civile.

I confini dei predetti tenimenti e casalino sono questi: da oriente vi è un casalino  scoperto, utilizzato per le scuole della Chiesa di Agrigento, che è della nostra stessa Chiesa, da occidente vi è la via pubblica e il muro della Città, da settentrione vi è similmente il muro della stessa Città, da mezzogiorno la via pubblica e il tenimento e il casalino hanno l’entrata e l’uscita.

Per la memoria futura tanto della Chiesa Agrigentina quanto del signor Conte e dei suoi eredi, sono stati redatti due documenti pubblici consimili, divisi dall’alfabeto, uno dei quali è il presente, fatto per cautela della nostra Chiesa Agrigentina da me predetto notaio, segnato con il mio solito sigillo, con le firme in alto del Giudice e del Notaio, con i sigilli pendenti dei predetti signori Vescovo e Conte, munito e roborato con le firme dei testimoni.

Fatto in Agrigento, nell’anno mese giorno e indizione premessi.

+     Noi Bertoldo, per grazia di Dio Vescovo di Agrigento, siamo stati presenti a tutte le cose premesse, abbiamo firmato e abbiamo interposto la nostra autorità, ordinando di apporre il nostro sigillo insieme al sigillo del predetto signor Conte.

+     Io, Salimbene, medico Giudice di Agrigento, ho firmato.

+     Noi, Manfredi di Chiaramonte, Conte di Modica, Signore di Ragusa e Regio Siniscalco, approviamo le cose predette e promettiamo di osservare inviolabilmente, ordinando di apporre il nostro sigillo nel documento rimanente della Chiesa.

In the name of the Holy Lord. Amen.

In the year of our Lord 1310, on the 28th of the month of July VIII indiction, while by God’s grace our King Federico III reigns, in the fifteenth year of his reign. Amen.
We Bertoldo, Bishop of Agrigento by God’s grace, through this public text, in the presence of the gentlemen Salimbene, physician and judge of the City of Agrigento, Giovanni di Pietro da Alessandria, public Notary of the City and of the witnesses here convened, convoked and personally invited for this express purpose, we declare and announce that mister Manfredi of Chiaramonte, Count of Modica, Lord of Ragusa and Royal Seneschal by God’s and the King’s grace, held a certain estate of houses both on ground level and above-ground in the aforementioned city of Agrigento, of which the confines will be later outlined, which soil, with a factory built upon it, was once granted by the Chapter of the Church of Agrigento to the noblewoman Giacinta di Catania upon the yearly payment of a wax roll and it was by her built as it is. We proceeded to take this estate back into the hands of the Church, as it was not convenient. However, the Count asked us for the estate and a small house located near our Church, usually granted together with the estate through a yearly payment, and asked us to grant those to him through a yearly payment, offering in exchange to give to our Church three rolls of wax for the estates and ten ounces of wax for the small house every year in occasion of the festivities of Saint Gerlando.
We, considering the benefit of the Church in the aforementioned concession, with the consent of the Canons of all of the Chapter of our Church, after a diligent discussion on this topic, and having fully examined this proposal with the purpose of doing what is best for our Church, rented and granted the aforementioned estate and small house to the Count and his heirs in exchange for the aforementioned three rolls of wax and ten ounces to be paid every year and in perpetuity to our Church in occasion of the festivities of Saint Gerlando.
We agree and promise to the Count and his heirs to defend, guarantee and protect from harassment they might receive from any public or private entity who might go against us, our successors in the Church or this very concession, and should the payment be defaulted for two consecutive years, we and our successors reserve the right to take back the estate and the small house, returning them to the Church. Furthermore, if they want to sell, dare they not sell without consulting our Church, and if it decides to buy, be it at a price reduced of a tenth, and dare they not sell to another Ecclesiastic Church or to a more powerful person.
Agreeing on all of the above, we promise for us and our successors to uphold the agreement through time and to inviolably observe it foregoing any right, be it written or not, with exception in the case of fraud, infringement of the contract conditions or illicit activities by the signer, in which case we may use to our advantage all constitutions and customs and generally any other aid or benefits that we may derive from both civil and canonical right.
The boundaries of the aforementioned estate and small house are as such: to the east there is a small house, used by the schools of the Church of Agrigento, belonging to our Church, to the west there are public streets and the wall of the city, to the north there is the city wall as well, in front of both there are public streets and both estate and house have entrance and exit.
For the sake of posterity both on the Church of Agrigento and on the Count and his heirs’ part, two public identical documents have been drafted, with this one being one of those, written to safeguard the Church of Agrigento by me, the aforementioned notary, signed with my personal seal, bearing the signatures of both the Judge and the Notary at the very top, awaiting for the seals of the Bishop and the Count, bearing and corroborated by the signatures of the witnesses.

+ We Bertoldo, Bishop of Agrigento by God’s grace, bore witness to all of the promises, have signed and exercised our authority, ordering to affix our seal together with the seal of the Count.
+ I, Salimbene, physician and judge of Agrigento, have signed.
+  We, Manfredi of Chiaramonte, Count of Modica, Lord of Ragusa and Royal Seneschal, approve of what is written above and we promise to observe it inviolably, ordering for our seal to be affixed in the document that will be kept by the Church.
